Provisions on Filing Laws Provisions on Filing Laws
(1) If the Commission recommends to the Government of Nepal to prosecute a perpetrator found guilty of serious violation of human rights, the Ministry shall send a written request to the Attorney General to prosecute such perpetrator.
(2) If a written request is received from the Ministry to prosecute a case according to sub-section (1), the Attorney General or the public prosecutor appointed by him shall decide whether or not to prosecute such perpetrator.
(3) Pursuant to sub-section (2), the Attorney General or public prosecutor shall disclose the basis and reason when deciding whether or not to prosecute the case.
(4) If it is decided to prosecute the perpetrator according to sub-section (2), the concerned public prosecutor shall prosecute the case in a special court. Explanation: For the purposes of this section, "special court" means a special court established by the Government of Nepal in accordance with the law to process and adjudicate cases decided by the Attorney General or the public prosecutor appointed by him on the basis of the recommendation of the Commission to prosecute any perpetrator in accordance with sub-section (2).
